Budigo Terms and Conditions of Use
Welcome to Budigo’s Terms and Conditions of Use (these “Terms”). This agreement outlines the legal relationship between you and Budigo, and it is essential that you understand your rights and responsibilities before using the Budigo website or mobile application (the “App”). By accessing, browsing, or using the App, you acknowledge that you have read, understood, and agreed to these Terms. We encourage you to also review our Community Guidelines and Privacy Policy, as they are integral parts of this agreement.
If you choose to subscribe to any paid service for a set period (the “Initial Term”), your subscription will automatically renew for the same duration at the current applicable rate unless you cancel it following the guidelines outlined in Section 6.
Additionally, Section 14 of these Terms includes important details about resolving disputes. Specifically, most disagreements between you and Budigo will be subject to binding arbitration, meaning they will be settled outside of court. You have the right to opt out of arbitration as described in Section 14. If you do not opt out, (1) you can only bring claims individually and not as part of a group or class action, and (2) you waive your right to a jury trial.
For California users, you have the right to cancel your subscription and request a refund before midnight on the third business day following your subscription date. If you subscribed via Apple, Apple handles all refund requests. For Google Play or direct Budigo subscriptions, please reach out to our support team for assistance.
1. BUDIGO USER GUIDELINES
To access and use the Budigo App, you must first register for an account (“Account”). By creating an Account, you confirm that you:
Are at least 18 years old or the legal age of majority in your country, whichever is higher.
Are legally allowed to use the App under the laws applicable in your jurisdiction.
We actively monitor for underage users. If we suspect that you do not meet the age requirement, we may suspend or terminate your Account or request age verification.
You can create an Account either manually or by signing in with a third-party service (e.g., Google, Apple). If you use a third-party login, you authorize Budigo to access limited information from that account, such as your profile picture and basic details. For more information about how we use your data, please review our Privacy Policy.
Each Budigo Account is personal and non-transferable. You may not use someone else’s Account or share your login credentials with others. You are responsible for all activity on your Account and must ensure compliance with these Terms at all times.
If you decide to leave Budigo, you may delete your Account at any time via Settings > Delete Account. While your profile will be removed immediately, it may take some time for all associated data to be fully erased from our system. If you attempt to create a new Account using the same credentials within 28 days, your previous Account may be automatically restored.
Enforcement and Account Restrictions
Budigo employs automated systems, user reports, and a moderation team to ensure compliance with these Terms. We reserve the right to restrict, suspend, or terminate any Account at our sole discretion, including blocking specific IP addresses.
For EU users, we will notify you if we take action against your Account unless restricted by law enforcement or legal obligations. If you believe an enforcement action was taken in error, you may appeal the decision within six months by following the instructions in the Community Guidelines or by contacting our support team.
For UK users, if you believe that Budigo has breached these Terms by limiting, removing, or restricting access to your content or Account, you have the right to file a breach of contract claim under local law.
You are prohibited from accessing, tampering with, or attempting unauthorized entry into non-public areas of the App or Budigo’s systems. Certain features may not be available unless you have a registered and verified Account.
2. CONTENT TYPES
On Budigo, you will encounter three main types of content:
Your Content – Anything you upload or share, such as profile details, messages, photos, and other media.
Member Content – Content shared by other users within the app.
Our Content – All content owned by Budigo, including software, graphics, trademarks, and database structures.
Content Guidelines
To foster a positive and safe environment, Budigo enforces strict Community Guidelines, which you agree to follow. These guidelines outline acceptable behavior and content, ensuring a respectful and enjoyable experience for all users.
The following types of content are strictly prohibited on Budigo:
Any material that is illegal, promotes unlawful activities, or incites violence.
Content that exploits or harms minors in any way.
Defamatory, libelous, or false information designed to mislead others.
Content that infringes on copyrights, trademarks, or other intellectual property rights.
Non-consensual images or information about others.
Content that is offensive, harassing, or meant to embarrass, threaten, or intimidate others.
Explicit, pornographic, or excessively violent material.
Hate speech, discrimination, or any content promoting racism, sexism, or bigotry.
Unsolicited advertisements, spam, or commercial solicitations.
Malicious software, phishing attempts, or anything designed to disrupt or harm the app or its users.
Impersonation, scams, or deceptive behavior designed to manipulate users.
Your Content
By sharing content on Budigo, you confirm that you have the right to post it and that it complies with our Community Guidelines. You are fully responsible for anything you share on the app. If your content violates these Terms, it may be removed, and your account may be suspended or terminated.
Budigo does not allow users to display personal contact information, financial details, or any other sensitive data on their profile. If you choose to share personal information with other users, you do so at your own risk. We encourage caution when communicating with others online.
By uploading content to Budigo, you grant us a non-exclusive, worldwide, royalty-free license to use, display, distribute, modify, and share your content for platform-related purposes, including but not limited to moderation, safety enforcement, and promotional activities. This license remains in effect even if you delete your account.
Budigo is not obligated to store or retain any of Your Content. If something is important to you, we recommend keeping a backup copy.
To prevent unauthorized use of Your Content outside of Budigo, you authorize us to take action on your behalf, including issuing takedown notices to protect your content from unauthorized third-party use.
Member Content
Content posted by other users belongs to them. You do not have ownership or rights to reuse, modify, or distribute another user’s content outside of Budigo.
Budigo is not responsible for the accuracy, reliability, or legality of Member Content. If you come across content that violates our guidelines, you can report it, and our team will take appropriate action.
Any misuse of another user’s information, including for spam, harassment, or commercial gain, will result in account suspension or termination.
Our Content
All Budigo-owned content, including trademarks, software, branding, and database structures, is intellectual property of Budigo. You are granted a limited, non-exclusive, revocable license to access and use the app for personal purposes only.
You may not:
Modify, sell, distribute, or create derivative works based on Budigo’s intellectual property.
Use Budigo’s branding or trademarks without written permission.
Reverse-engineer, scrape, or tamper with Budigo’s software or systems.
Use our content for commercial purposes without authorization.



Image Attribution
Some profile images used in the app promotional materials and within the app interface are sourced from Unsplash. These images are licensed under the Unsplash License, which allows free commercial and non-commercial use without requiring permission or attribution. However, we acknowledge and appreciate the work of talented photographers available on Unsplash.

Content Moderation
Budigo reserves the right to review, remove, or restrict content that violates these Terms. This includes both public posts and private messages exchanged within the app.
Recommendation System
Budigo uses matching algorithms to suggest potential connections based on user preferences and compatibility. To learn more about how our recommendation system works, please review our Privacy Policy.
3. RESTRICTIONS ON THE APP
By using Budigo, you agree to:
Abide by all relevant laws, including but not limited to privacy, intellectual property, anti-spam, and consumer protection regulations.
Provide accurate and truthful personal information, including your real name and age, when registering and using your Budigo account.
Use Budigo in a responsible, respectful, and inclusive manner while adhering to our Community Guidelines.
Prohibited Activities
To maintain a safe and enjoyable platform, the following actions are strictly prohibited on Budigo:
Engaging in any illegal, abusive, deceptive, or harmful activities.
Misrepresenting your identity, age, affiliations, or qualifications.
Sharing private or confidential information without consent.
Harassing, stalking, threatening, or intimidating other users.
Engaging in deceptive practices, scams, fake profiles, or other manipulative behavior.
Submitting false reports, complaints, or fraudulent appeals.
Using bots, scrapers, or any unauthorized software to collect user data or manipulate the platform.
Enforcement and Reporting
Budigo takes user safety seriously. You can report any violations of these Terms by using the Block & Report feature on a user’s profile or within the chat. Our team will investigate and take appropriate action, which may include content removal, account suspension, or permanent banning.
Budigo reserves the right to immediately terminate or restrict any account at our sole discretion if we determine a user has violated these Terms, engaged in inappropriate behavior (online or offline), or if there is a valid reason to do so. This may include banning accounts that have engaged in misconduct on other platforms operated by our affiliates.
If your account is restricted or terminated due to a violation, you will not be eligible for a refund of any paid services. If you believe an action taken against your account was in error, you have the right to appeal within six months by following the process outlined in our Community Guidelines.
For users in the European Union (EU), you may also seek resolution through out-of-court dispute settlement, take legal action in your country of residence, or file a complaint with your local regulatory authority under the Digital Services Act.
Criminal Background Investigations
In certain cases, such as when there are reports of serious misconduct, Budigo may conduct investigations to determine whether a user has a criminal history. This may involve checking publicly available databases, including sex offender registries and other legal records.
If we reasonably believe a user has been convicted of serious crimes—such as sexual assault, human trafficking, stalking, kidnapping, child abuse, domestic violence, murder, hate crimes, terrorism, or other violent offenses—Budigo reserves the right to permanently ban that person from the platform.
However, these checks are not foolproof and may not be conducted on all users. Not all criminal records are public, and databases may be outdated or incomplete. Users should exercise caution when interacting with others and report any suspicious behavior.
User Liability and Waiver of Claims
By using Budigo, you acknowledge that we do not control user interactions and cannot be held responsible for actions taken by other members. You agree to release Budigo from any claims, damages, or losses arising from your interactions with others on the platform.
For users in California, you waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release."
This waiver does not apply in cases of fraud, deceptive practices, or violations of applicable consumer protection laws by Budigo.
Data Scraping and Unauthorized Access
Budigo strictly prohibits the scraping, copying, or replication of any part of the app or its user data without explicit permission. Unauthorized attempts to collect or manipulate data using automated tools, software, or bots are violations of these Terms and may result in legal action.
4. COLORADO SAFETY POLICY
In addition to the general Terms, the following safety provisions apply specifically to users residing in Colorado.
Budigo is committed to creating a secure and respectful environment for all users. As part of this commitment, we enforce strict guidelines regarding acceptable content and conduct, both on and off our platform.
By using Budigo, you agree to comply with our Community Guidelines, which outline the behaviors and content permitted on the app. These guidelines are updated periodically, and users are responsible for staying informed of any changes.
Prohibited Content and Conduct
To maintain a safe and welcoming community, certain types of content and behavior are strictly prohibited, including but not limited to:
Illegal activities or content that promotes, encourages, or incites unlawful behavior.
Harm to minors, including any form of abuse, endangerment, or misconduct that threatens personal or public safety—such as attempted homicide, sexual misconduct, assault, kidnapping, stalking, harassment, involuntary intoxication, robbery, theft, or any other actions that could compromise the well-being of others.
Defamatory, libelous, or misleading content intended to harm someone’s reputation.
Intellectual property violations, including the unauthorized use of copyrighted material, trademarks, or any content that infringes on the rights of others.
Non-consensual sharing of personal images or content depicting another person without their explicit permission.
Offensive, harassing, or alarming content, including language or imagery that could cause distress, humiliation, or emotional harm to others.
Obscene, pornographic, or violent material that may degrade human dignity.
Hate speech and discrimination, including content that is racist, sexist, homophobic, xenophobic, or promotes bigotry in any form.
Unauthorized commercial activities, such as advertisements, promotions, sales, or the distribution of external links for business purposes.
Spam and fraudulent activity, including sending mass messages, phishing, impersonation, scams, or deceptive practices.
Malware and security threats, such as spyware, adware, viruses, worms, Trojans, or any software designed to harm or exploit Budigo’s platform, users, or data.
Any other content or actions that violate Budigo’s Community Guidelines or compromise the integrity of our platform.
Users found violating these policies may face immediate content removal, account suspension, or permanent banning at Budigo’s discretion.
If you encounter or suspect any prohibited behavior, you are encouraged to use our Block & Report feature to notify our moderation team. Our goal is to ensure that Budigo remains a safe, enjoyable, and trustworthy space for all members.
Background Checks & User Safety Policy
At Budigo, maintaining a safe and respectful community is a top priority. We take necessary precautions to ensure that all users adhere to our platform’s standards and policies.
Background Checks
In certain circumstances—such as reports from users or media coverage of potential misconduct—Budigo may conduct background checks on members. This may include searching publicly available records, such as sex offender registries or other relevant databases, to determine if a user has a history of criminal activity.
If an investigation identifies a criminal conviction, Budigo reserves the right to assess whether the individual in question is the same as the user under review. If we find that a user has been convicted of offenses such as sexual assault, harassment, human trafficking, stalking, kidnapping, child abuse, domestic violence, murder, hate crimes, terrorism, or violent extremism, we may permanently block that person from accessing the platform and communicating with other users.
Budigo also retains the right to restrict or remove users for other criminal offenses or violations of our Terms, even if not explicitly listed above. However, background checks are not foolproof, as not all criminal records are public, and some offenders may evade detection. Users should always exercise caution when interacting with others.
Identity Verification
To register for Budigo, users must be at least 18 years old or the legal age of majority in their country. We actively monitor underage accounts and may suspend, request verification, or terminate accounts if we suspect a user is underage.
When a User May Be Suspended or Blocked
Budigo enforces strict adherence to our Community Guidelines. Violations of our rules, platform policies, or behavior deemed harmful to other users may result in immediate action. When reviewing violations, we consider multiple factors, including the severity and frequency of offenses.
Actions we may take against violators:
Removal of content that breaches our policies
Issuing a warning for first-time or minor infractions
Banning the user from Budigo or affiliated platforms for repeated or serious violations
Cooperating with law enforcement in cases involving criminal activity
Behavior outside of the Budigo app can also impact your account. If we receive credible reports of harmful conduct that occurred through in-person interactions, social media, or other messaging platforms, we may take disciplinary action against your Budigo account.
Filing False Reports: Users are prohibited from submitting false, malicious, or biased reports against other members. Abuse of our reporting system may lead to penalties, including account suspension.
Appeals Process
If you believe your account or content was removed in error, you may appeal within six months of the action. To appeal:
Review the Community Guidelines to ensure you understand why the action was taken.
Use the appeals form in the notification received within the app.
Alternatively, you can contact our support team, providing details about your appeal.
User Reporting & Anonymity
When a user files a report (e.g., via the "Block & Report" feature), our support team reviews the case and takes action based on our Community Guidelines. Budigo does not inform the reported individual about who submitted the report.
Consent & Sexual Conduct Policy
Consent is mandatory at all times. All Budigo users must respect personal boundaries and never assume what someone is comfortable with. Consent can be withdrawn at any time.
Sexual coercion, non-consensual advances, or engaging in any behavior that violates consent may result in account termination and, where applicable, legal consequences.
Safety Resources & Support
Budigo collaborates with trusted organizations to offer support and resources for users affected by harassment or abuse.
Trauma Support with Bloom: We partner with Bloom, operated by Chayn, to provide free online trauma recovery courses and 1:1 chat support for survivors of sexual assault and relationship abuse. These courses include guidance on setting boundaries, healing from trauma, and navigating dating safely.
Secure Law Enforcement Communication via Kodex: Budigo partners with Kodex, a data-sharing portal, to facilitate secure communication with verified legal authorities when necessary.
Proactive Safety Measures
To maintain a safe platform, Budigo utilizes:
Human moderation & AI-powered detection to review and remove harmful content
User reporting tools to help flag inappropriate behavior
Strict verification systems to prevent impersonation and fake profiles
Users play a crucial role in keeping Budigo safe. If you encounter suspicious behavior, we encourage you to use the Block & Report feature immediately.

5. PRIVACY
At Budigo, we prioritize your privacy and data security. To understand how we collect, store, use, and share your personal data, please refer to our Privacy Policy.
By using Budigo, you acknowledge and consent to our data practices, which ensure transparency and compliance with relevant privacy laws and regulations. Your personal information is handled responsibly, and we implement strict measures to protect your data from unauthorized access, misuse, or disclosure.

6. PAYMENT TERMS
General Information
Budigo offers various in-app purchases for additional features and services. By making a purchase within the Budigo app, you acknowledge and agree that additional terms may apply at the point of purchase.
You can complete transactions through third-party payment platforms, including the Apple App Store, Google Play Store, or directly via credit card, debit card, or PayPal. Payments are securely processed by third-party providers. Once a payment is made, you authorize Budigo to charge your selected payment method. If payment is declined or not received, you agree to settle the outstanding amount promptly.
Subscriptions & Auto-Renewal
Budigo may offer auto-renewing subscription plans for premium services, such as weekly, monthly, or multi-month subscriptions.
If you subscribe to an auto-renewing plan, your subscription will automatically renew at the end of each billing cycle at the current rate unless you cancel it before the renewal date.
Deleting your account or the app does not cancel your subscription.
If Budigo updates subscription pricing, we will notify you in advance, allowing you the option to cancel before the new rates apply.
If you do not cancel, you authorize Budigo to charge your payment method at the updated rate.
Subscription Cancellation
If you subscribed through Budigo directly, you can manage or cancel your subscription in the payment settings within the app.
If you subscribed via Apple App Store or Google Play Store, you must cancel through your respective app store settings.
Upon cancellation:
You will retain access to your subscription until the current billing period ends.
You will not receive a prorated refund for the unused portion of your subscription unless otherwise specified below.
Refund Policy
All purchases are final and generally non-refundable. However, certain regions may have specific refund policies:
For users in select U.S. states (Arizona, California, Colorado, etc.):
You may cancel your subscription within three business days of purchase to receive a full refund (excluding Sundays and holidays).
If you pass away or become disabled before the end of your subscription, your estate or you may request a refund for the unused portion.
For users outside the U.S.:
Weekly subscriptions: Refunds may be requested within six days of purchase (minus any used portion).
Monthly or longer subscriptions: Refunds may be requested within 14 days of purchase (minus any used portion).
Subscription renewals are non-refundable.
Blocked users are not eligible for refunds.
How to Request a Refund
To request a refund:
Apple App Store users: Refunds are handled by Apple. Visit Apple Support to submit a request.
Google Play Store users: Refunds are processed by Google. Go to your Google Play account, find the transaction, and select "Report a Problem" to request a refund.
Direct Budigo purchases: Contact Budigo Support with your order number and account details.
Taxes
All applicable taxes (such as VAT or sales tax) are additional to the subscription fee. If required by law, Budigo will collect applicable taxes at checkout. If you are responsible for additional tax payments in your region, you must handle those obligations independently.

7. VIRTUAL ITEMS
At Budigo, users may have the option to purchase virtual items, which grant a limited, non-transferable, non-sublicensable, and revocable license to access exclusive features. These virtual items are available only through Budigo and its authorized partners. Ownership of virtual items remains with Budigo, and purchasing them does not constitute a transfer of property rights.
Virtual items are not real-world currency and hold no cash value. They can only be used within the Budigo platform and do not accumulate interest or incur inactivity fees. Budigo reserves the right to modify, regulate, or remove virtual items at any time without compensation to users.
All purchases of virtual items are final and non-refundable. Once your account is suspended or terminated, any remaining virtual items in your account may be forfeited.
Budigo Diamonds
Users can purchase Budigo Diamonds ("Diamonds") through authorized payment methods. All transactions are processed in the currency shown at checkout, and any applicable fees or exchange rates are determined by your payment provider.
Budigo also collaborates with authorized Diamond vendors on the platform. When purchasing Diamonds from third-party vendors, ensure they are verified sellers, as Budigo is not responsible for disputes between users and vendors, except in cases where technical issues prevent a recharge.
Once purchased, Diamonds are credited to your user account and cannot be exchanged for cash. Diamonds may only be used within Budigo and cannot be sold, traded, or transferred between users.
If a user's account is terminated due to violations of Budigo’s Terms, all unused Diamonds will be forfeited. Budigo maintains full control over pricing, availability, and modifications of Diamonds and will not be liable for any changes in value.

Refund Policy for Diamonds
Diamonds cannot be refunded, exchanged, or transferred. If an account is terminated due to violations of Budigo’s policies, any remaining Diamonds will be revoked without compensation.
Virtual Gifts
Virtual Gifts ("Gifts") are digital items that can be obtained using Diamonds. These Gifts may be sent to other users to show appreciation for their content or engagement on the platform.
The exchange rate between Diamonds and Gifts is determined by Budigo and may be adjusted at any time. Gifts cannot be converted back into Diamonds or exchanged for cash.
Once a Gift is sent, it will appear publicly on the recipient’s profile, and the sender’s username and details of the Gift will be visible to others. By sending a Gift, you consent to this information being publicly displayed.
If a user’s account is suspended or terminated for policy violations, all remaining Gifts may be removed without reimbursement.
Priority Match
Budigo offers Priority Match, a service that enhances matchmaking by increasing visibility and boosting user connections.
Priority Match features and pricing may be adjusted at Budigo’s discretion.
The service is non-refundable, and any technical issues affecting Priority Match will be investigated but will not qualify for Diamond refunds.

Reward Credits (Diamonds)
Users who receive Gifts from others may earn Reward Credits ("Diamonds"), which represent engagement and popularity on the platform.
Diamonds cannot be purchased; they are earned through Gift interactions.
The exchange rate between Gifts and Diamonds is set by Budigo and may be modified without prior notice.
Diamonds can be converted into cash, but they cannot be exchanged for Diamonds or transferred between users.
If a user is found violating Budigo’s Terms, their Diamonds may be revoked. Budigo reserves the right to suspend or modify the Reward Credits system at any time.


Withdrawing Diamonds
Users can withdraw Diamonds in exchange for monetary compensation, which will be transferred to a designated third-party payment account (e.g., PayPal, bank transfer).
The conversion rate for Diamonds will be displayed at the time of withdrawal.
Withdrawals are subject to daily limits and eligibility checks.
Budigo reserves the right to verify user identity before processing payments.
There is no guarantee of withdrawal processing time, and delays may occur.
Any applicable taxes related to Diamonds are the user’s responsibility. If tax documentation is required, Budigo may withhold or deduct the necessary amount.
Failure to comply with tax obligations may result in deductions from future withdrawals.
By using Budigo’s virtual currency and rewards system, users agree to abide by these terms and understand that all transactions within the platform are final and non-refundable.

8. PUSH NOTIFICATIONS & LOCATION-BASED FEATURES
Push Notifications & Communications
Budigo may send you emails, text messages, push notifications, alerts, and other communications regarding platform updates, promotions, new features, and special offers.
When you first download and install the app, you will be prompted to allow or deny push notifications.
If you deny push notifications, you will not receive any alerts or promotional messages.
If you accept, push notifications will be automatically enabled on your device.
You can disable push notifications anytime by adjusting the notification settings on your mobile device.
For other types of communications, such as emails and SMS notifications, you can unsubscribe by:
Following the opt-out instructions provided in the message.
Contacting Budigo customer support and requesting to be removed from promotional communications.
Location-Based Features
Budigo offers location-based services to enhance your experience, such as matching with users nearby, location-based content, and event recommendations.
The app determines your location using GPS, Bluetooth, and/or mobile device software.
If you disable GPS, Bluetooth, or location permissions on your device, you will not be able to access location-based features.
By enabling location services, you consent to Budigo collecting and using your location data as outlined in the Privacy Policy.

9. DISCLAIMER
The Budigo app, website, all platform content, and user-generated content are provided to you "as is" and "as available" without any warranties, whether express or implied. This includes, but is not limited to, implied warranties of suitability for a particular purpose, ownership rights, or non-infringement.
Budigo does not guarantee that:
Matches or connections will be compatible or successful.
The app or website will always be available, uninterrupted, or error-free.
The content on the platform, including user-generated content, is always accurate, reliable, or up to date.
By using Budigo, you acknowledge that you are solely responsible for your interactions with other users, and Budigo does not conduct criminal background checks on its members.
If applicable law does not permit the full exclusion of warranties, Budigo will provide only the minimum level of warranty required by law. No advice, whether written or verbal, will create any additional warranty beyond what is stated in these terms.
Your use of Budigo is at your own risk, and the platform is not responsible for the behavior, actions, or communications of any user.
10. LIMITATION OF LIABILITY
Neither Budigo nor any of its owners, affiliates, or partners shall be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, revenue, profit, goodwill, personal or business opportunities, or property damage arising from or related to your access or use of the Budigo app, website, our content, or any user-generated content. This applies regardless of whether the cause is based on contract breach, negligence, intellectual property infringement, product liability, or any other legal theory.
These limitations apply even if we have been advised of the possibility of such damages. If you are dissatisfied with the app, its services, or any aspect of Budigo, your sole and exclusive remedy is to discontinue use of the platform.
By using Budigo, you waive any and all claims related to your use of the app or website. Since some jurisdictions do not permit the exclusion of certain warranties or limitations on damages, some provisions of this section may not apply to you. If any part of this limitation on liability is deemed unenforceable, our total liability shall not exceed one hundred dollars ($100).

These disclaimers, exclusions, and limitations shall survive even if any specific remedy is found to have failed in its essential purpose.
However, this limitation of liability does not apply to cases involving fraudulent misrepresentation, gross negligence, or any other liability that cannot be excluded under applicable law.
11. INDEMNITY
All actions you take and content you share on Budigo are solely your responsibility. By using the platform, you agree to indemnify, defend, release, and hold Budigo, its partners, licensors, affiliates, contractors, officers, directors, employees, representatives, and agents harmless from and against any third-party claims, damages (whether actual or consequential), actions, legal proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) incurred as a result of:
Any negligent acts, omissions, or intentional misconduct by you.
Your access to and use of Budigo.
Any content you upload, share, or submit through the platform.
Any breach of these Terms by you.
Your violation of any laws or infringement of third-party rights.
Budigo reserves the exclusive right to settle, compromise, or resolve any claims brought against it without requiring your prior consent. If requested, you agree to cooperate fully and reasonably in defending any legal claims or disputes.
This provision does not require you to indemnify Budigo for any fraudulent, deceptive, or unconscionable business practices or any form of misrepresentation, false advertising, or suppression of material facts related to the platform.
12. PROCEDURE FOR REPORTING COPYRIGHT INFRINGEMENT
If you believe that any content on Budigo infringes your copyright, you may submit a Copyright Infringement Notice (“Takedown Notice”) to Budigo’s Copyright Agent. Your Takedown Notice must include the following details:
Your Signature – A physical or electronic signature of the person authorized to act on behalf of the copyright owner whose rights have allegedly been infringed.
Identification of the Copyrighted Work – A description of the copyrighted material that has allegedly been infringed. If multiple works are affected, a representative list of those works.
Identification of the Infringing Material – A clear description of the specific content that is claimed to be infringing, including details sufficient to help Budigo locate the material (such as URLs or usernames).
Your Contact Information – Your name, mailing address, phone number, and email address to allow Budigo to contact you regarding your claim.
Good Faith Statement – A declaration stating that you believe, in good faith, that the disputed use of the copyrighted material is not authorized by the copyright owner, their agent, or applicable law.
Accuracy and Authorization Statement – A statement, made under penalty of perjury, confirming that the information provided in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

13. THIRD-PARTY APP STORE TERMS
If you download Budigo from a third-party app store (such as the Apple App Store or Google Play Store), the following additional terms apply. If there is any conflict between this section and the rest of these Terms, the more restrictive or specific terms in this section will take precedence, but only in relation to the app store provider.
1. Agreement Between You and Budigo
These Terms are agreed upon solely between you and Budigo, not with the third-party app store provider. Budigo is fully responsible for the app and its content, while the app store provider bears no responsibility for its functionality, content, or any issues related to your use of the app. If any app store terms conflict with these Terms, the app store’s terms will override Budigo's Terms only where necessary.
2. Maintenance & Support
The third-party app store provider has no obligation to provide maintenance, updates, or support for the Budigo app. Any maintenance or support will be handled exclusively by Budigo.
3. Warranty & Liability
Budigo is solely responsible for any product warranties, whether expressed or implied by law. The third-party app store provider has no warranty obligations for the app, and any claims, issues, or damages related to Budigo are the sole responsibility of Budigo and not the app store.
4. Claims & Disputes
Budigo, not the third-party app store, is responsible for handling any claims you or third parties may have in relation to the app, including but not limited to:
Product liability claims
Failure to meet legal or regulatory requirements
Consumer protection claims
Intellectual property infringement claims
5. Third-Party Store Rights
The app store provider and its affiliates are considered third-party beneficiaries of these Terms. By downloading Budigo, you agree that the app store provider has the right to enforce these Terms against you as a third-party beneficiary if necessary.
6. Third-Party Transactions
If you purchase goods or services through a third-party app store or mobile carrier, Budigo is not responsible for those transactions. You are encouraged to conduct your own research and due diligence before proceeding with any transactions involving third-party services.

14. DISPUTE RESOLUTION
Please read this Arbitration Agreement carefully. Unless you opt out as outlined in Section 14(10), this Agreement requires you and Budigo to resolve disputes through binding arbitration instead of court proceedings and limits the types of legal actions that can be pursued.
1. When Does This Arbitration Agreement Apply?
This Arbitration Agreement applies to all claims or disputes (whether based on contract, tort, law, fraud, misrepresentation, or any other legal theory) between you and Budigo, arising from:
Your use of the Budigo app or platform
The enforcement, interpretation, or validity of these Terms
Any relationship you have with Budigo, even if the dispute arose before these Terms took effect
By agreeing to this section, you agree that all disputes must be resolved through arbitration, except for:
Small claims court cases, if your claim qualifies
Claims related to intellectual property rights, which may be pursued in court
2. Notice of Dispute and Informal Resolution
Before initiating arbitration, both parties must first attempt to resolve the dispute informally. You must provide a written notice of your dispute to Budigo’s registered address, including:
Your name, email, phone number, and account details
A detailed description of the dispute
The specific relief you seek
Both parties will have 60 days to engage in good-faith discussions via email, video call, or phone call to attempt resolution. If no resolution is reached, you may proceed with arbitration.
3. How to Start Arbitration
If the informal resolution fails, arbitration may be initiated by:
Sending a formal demand for arbitration to Budigo via certified mail.
The demand must include the details of the dispute and the relief sought.
Budigo will respond in accordance with the rules of the arbitration provider.
4. Arbitration Rules
Arbitration will be conducted under the Federal Arbitration Act (FAA).
If the FAA does not apply, arbitration will follow the laws of the state of Delaware.
The arbitration provider depends on your location:
If you live in the United States, arbitration will be administered by National Arbitration and Mediation (NAM).
If you live outside the United States, an alternative arbitration provider will be determined.
The arbitration provider’s rules will apply, except where they conflict with this agreement, in which case this agreement will take precedence.
5. What Can the Arbitrator Decide?
The arbitrator has the power to:
Determine whether a claim is eligible for arbitration
Award damages and non-monetary relief
Issue a final and legally binding decision
A written statement of the arbitrator’s findings will be provided to both parties.
6. No Jury Trials
By agreeing to arbitration, both parties waive their rights to a jury trial. The arbitrator’s decision is final and replaces any right to court proceedings.
7. Individual Arbitration Only
All claims must be arbitrated on an individual basis—not as a group or class action. You waive your right to participate in any class-action lawsuit.
8. Mass Filings & Special Rules
If 30 or more individuals file similar arbitration claims against Budigo, the following rules will apply:
The first 10 cases will proceed as "test cases" to determine the outcome of similar claims.
If no resolution is reached, cases may proceed to a global mediation process.
If mediation fails, batch arbitration may be implemented, where claims are grouped into sets of 100 for efficiency.
If a court determines that these mass filing rules are unenforceable, cases will be moved to court instead of arbitration.
9. Offer of Settlement
Either party may offer a settlement before the arbitration hearing. If the final decision is less favorable than the initial settlement offer, the losing party may have to pay additional legal fees.
10. How to Opt Out of Arbitration
You can opt out of arbitration within 31 days of first agreeing to these Terms.
To opt out, send an email to info@budigo.io with:
Your name, account details, and a clear statement opting out.
Opting out of arbitration does not affect any other part of these Terms.
11. Severability
If any part of this Arbitration Agreement is found to be unenforceable, the remaining sections will still apply.
12. Agreement Survival
This Arbitration Agreement remains in effect even after you stop using Budigo.




15. USE OF THIRD-PARTY INTEGRATIONS
If you use augmented reality (AR) features or third-party integrations within the Budigo app, such as Snap Lenses or similar services, you will be subject to the terms and conditions of the respective third-party provider. This may include an arbitration clause and a waiver of class-action lawsuits or arbitration rights.
By using any third-party AR features, you agree to their terms of service. If you do not agree, you should avoid using those features in the Budigo app.

16. ACCOUNT TERMINATION AND ENFORCEMENT
Termination by You
You may delete your Budigo account at any time by:
Logging into the app
Navigating to Settings
Selecting "Delete Account"
Important Notes:
Deleting your Budigo account does not automatically cancel your subscription. You must cancel any recurring payments through the app store or third-party provider (e.g., Apple App Store, Google Play).
Refunds are not provided for unused subscription time except where required by law or as stated in Section 6.
Termination by Budigo
Budigo reserves the right to suspend or terminate your account at its sole discretion, without prior notice, if:
You violate any part of these Terms
Your activity is fraudulent, abusive, or unlawful (either on or off the app)
You misuse the platform in a way that harms Budigo or other users
If Budigo terminates your account, it may:
Remove your content
Disable your profile permanently
Cancel your subscription without refund
Report unlawful behavior to authorities
Once an account is terminated, access to all associated data, features, and content is permanently lost.
Survival of Terms After Termination
Certain provisions of these Terms will remain in effect even after account deletion or termination, including but not limited to:
Privacy obligations
Intellectual property rights
Arbitration agreements
Disclaimers and limitations of liability
Your information will be stored or deleted in line with our Privacy Policy.

17. MISCELLANEOUS PROVISIONS
Entire Agreement
These Terms of Service constitute the entire agreement between you and Budigo, overriding any prior agreements (written or verbal) regarding the app’s usage.
No Guarantees or Warranties
While Budigo strives to provide a safe and reliable platform, we do not guarantee that:
The app will always function without errors or interruptions
All data and content are accurate and up-to-date
The app is free of viruses or security threats
You acknowledge that using Budigo is at your own risk.
Electronic Communication Consent
By using Budigo, you consent to receive electronic communications, including emails, push notifications, and in-app messages, related to:
Service updates
Legal notifications
Promotional content (which you can opt out of)
These digital communications hold the same legal weight as written notices.
Changes to These Terms
As Budigo evolves, we may update these Terms of Service. When we do:

18. GOVERNING LAW AND JURISDICTION
Subject to Section 14(3) and any applicable mandatory laws in your country of residence, your access to Budigo, its content, and any user-generated content, as well as any disputes arising from your use of the app, are governed by the laws of the London, UK.
Any claims that are not subject to arbitration (including challenges to the enforceability of arbitration provisions) shall be resolved exclusively in the courts of London.
By using Budigo, you:
Consent to the personal jurisdiction of these courts
Waive any objections based on an inconvenient forum
Agree not to file or participate in any class action against Budigo

Authenticity and Integrity

Spam and Platform Manipulation

Multiple accounts used for spam or fake engagement will be permanently banned.
